Stephen's Constiutional Amendments

Hi ASB!

As you may know from our discussion in the Leadership Class, I have proposed 12 amendments to the ASB Constitution. After getting feedback from multiple people, I have decided to make a few slight changes to my amendments. Attached below are the amendments listed in order of presentation and I have bolded the amendments that have been slightly tweaked. I also have condensed the first 5 amendments into 2 amendments but in essence, the changes I want to make are identical. (This is so that voting will be easier on the actual Executive Council meeting.)

Amendment 1-2 Housekeeping
1. Deleting outdated sections of the constitution such as:
In the case of a paper ballot, there shall be a recount in the event that any candidate wins by a margin of less than 1% of all votes cast.
Article IV, Section D, Paragraph 1

The Social Manager shall preside over the Social Committee. He/she shall be responsible for all ASB sponsored social events and activities.
Article V, Section E

The ASB President or Vice President shall preside at all Legislative Council meetings as the Speaker of the Legislative Council

2. Adjusting syntax of the Constitution
Changing this
The Vice President shall succeed to the presidency in the case that the position is vacant.
 to
The Vice President with the most votes shall succeed to the presidency in the case that the position is vacant.

Social Committee ⇒ Commission of Social Activities
Article VIII, Section G

Legislative Representative ⇒  Legislative Council Representative (14 times)

3. Redefining simple majority

Simple majority is defined as 50% of voters plus one additional vote.
Article IV, Section C

Why is this bad?
In a group of 7, a simple majority would be 50% of 7 + 1 (Note: 3 is less than 50% of 7)
This would be 3.5 + 1 = 4.5, which would round up to 5
You would need 5 people ~71.4% of the vote to get it passed through “simple majority”


Proposed Change: 

Simple majority is defined as more than 50% of the vote.

Why is this better?
In a group of 7, simple majority is more than 50% of 7
In this situation, 4 people (a majority) would be enough to pass  


4. Formalizing ASCC

Article VII. ASCC
Section A - The ASB-Staff-Class Council shall consist of the Assistant Principal of Activities,  Class Advisors, ASB Officers, and Class Officers
Section B - Meetings
 i. ASCC shall meet at least twice a year. Additional meetings may be deemed necessary by the ASB President, any Class President, Leadership Advisor, or the Assistant Principal of Activities.
ii.  Quorum for meetings shall consist of at least three Class Officers from each class, 4 ASB Officers, and the Assistant Principal of Activities or the Leadership Class Advisor.



5. Formalizing Executive Council Voting

 ii. Passing procedure will be conducted as follows: a voting member will move to approve a proposal and a second voting member will second the proposal. Only once a proposal has been seconded can it move to a vote. The voting procedure will consist of voting members having the option to vote three possibilities on a paper ballot: Yes, No, or Abstain. 


6. Interim period between a proposal and Executive Council Vote

iii. All proposals shall be made known to members of the Executive Council at least one week prior.

Section D- Quorum
 i. A quorum for the Executive Council is present when ⅔ of members are present.
ii. Only members who are present during Council meetings will count for quorum 
iii.  If a member of the Executive Council has a school sanctioned absence, then they are eligible to vote as long as they send in an absentee ballot to the Leadership Advisor before the Executive Council Meeting

i. Candidates can request from the Assistant Principal of Activities the margin of their election.
